Terms of Use

1. About these terms

These Terms of Use apply to your use of any websites, client portals, online claims forms, and payment services provided by or on behalf of Gallagher Insurance New Zealand our ”Online Services”.

Some of our Online Services may be provided or supported by third‑party service providers acting on our behalf.

By accessing our services, you agree to these Terms of Use.  If you do not agree, please do not use them.

We may update these terms from time to time. Changes apply once they are published on this page. 

2. Who we are 

We are Gallagher Insurance New Zealand (including Arthur J. Gallagher & Co (NZ) Limited, Monument Insurance (NZ) Limited, Monument Premium Funding Limited, and Offshore Market Placements Ltd), part of the Arthur J. Gallagher group (“Gallagher”, “we”, “us”, or “our”). 

3. Using our Services  

You may use our Online Services for lawful purposes only.   

You must not: 

• break the law 
• interfere with security or performance  
• try to access systems or data without permission 
• misuse our Online Services or harm others 
• introduce viruses or other harmful material  

We may restrict or suspend access to our Online Services if we reasonably believe they are being misused or pose a security risk. 

4. Online Services content 

Content in our Online Services is for general information only, and is not financial advice or a replacement for advice from your Gallagher broker. 

Talk to your Gallagher broker before making insurance or risk decisions. 

While we take reasonable care, we do not guarantee that information is always complete, current, or suitable to your circumstances. 

5. Accounts 

Some of our Online Services, including client portals, require you to create or use a login account. 

When you use an Online Service that requires an account, you agree that: 

• you are responsible for keeping your login details secure 
• you will not share your login details  
• you are responsible for all activity on your account 
• you will notify us promptly of unauthorised access 
• you will ensure your details are accurate 

We may suspend or permanently disable your account if: 

• there is unauthorised access or misuse 
• if you breach these terms 
• required for legal, regulatory, or security reasons 

6. Terms of Business 

Your insurance arrangements are governed by our Terms of Business and related documents. Our Terms of Business explain: 

• how we provide our services 
• our roles and responsibilities 
• commissions, fees, and disclosures 
• your obligations as a client

If there is a conflict  between these Terms of Use and the Terms of Business, the Terms of Business will apply for insurance services. 

7. Payments 

If you make payments through our Online Services using a credit or debit card or other electronic payment method: 

• payments are processed through secure independent third‑party payment processors 
• Gallagher does not own, operate, or control these payment providers 
• we do not store your full card details on our systems 
• you are responsible for ensuring payment details are accurate and that you are authorised to use the payment method 

Your use of third‑party payment services may also be subject to those providers’ own terms and conditions. 

Payments are processed by third party providers.  To the extent permitted by law, we are not responsible for issues caused by those providers.

Payment issues or refunds may need to be resolved with the provider. 

8. Privacy

When you use our Online Services, we may collect personal information about you. 

We handle your personal information in line with the Privacy Act 2020 and our Privacy Policy.  By using our Online Services, you agree to how we handle personal information as described in our Privacy Policy. 

9. Data security

While we take reasonable steps to protect security, no online system is completely secure. You are responsible for maintaining the security of your own devices and login details. 

10. Links  

Our Online Services may contain links to third‑party websites or services. 

Links are for convenience only.  We do not control or endorse those websites. 

11. Intellectual property 

All content on our Online Services (including text, images, logos, and design) is owned by or licensed to Gallagher unless stated otherwise. 

You may use our content for personal or internal business use only. You must not copy, reproduce, modify, or distribute content for commercial purposes without our prior written consent. 

12. Availability  

We aim to keep our Online Services available, but we do not guarantee uninterrupted access.  We may change or suspend them at any time. 

13. Liability 

To the extent permitted by law, we are not liable for loss resulting from your use of our Online Services, including indirect or consequential loss.  Nothing in these terms limit your rights under the Consumer Guarantees Act 1993 or other applicable laws. 

14. Governing law 

These Terms of Use are governed by the laws of New Zealand.
